The Oakland Public Education Fund leads the development and investment of community resources into Oakland public schools so that all students can learn, grow, and thrive. Thank you for your interest in volunteering for the 2022-23 school year. In order to be eligible to volunteer in-person at Oakland public schools and/or other volunteer locations as requested, please read and sign this waiver. Volunteer opportunities at OUSD will be offered at various locations and on dates to be determined. As a condition to participating in OUSD as a volunteer, you must be willing and able to confirm each of the following, by signing your initials in all the spaces below and signing the signature page at the end.

El Fondo de Educación Pública de Oakland (en inglés: “Oakland Public Education Fund [OPEF]”) lidera el desarrollo e inversión de recursos comunitarios en las escuelas públicas de Oakland para que todos los estudiantes puedan aprender, crecer, y prosperar. Gracias por su interés en ofrecerse como voluntario para ayudar a el Distrito Escolar Unificado de Oakland (en inglés: “Oakland Unified School District [OUSD]”) a ofrecer educación en persona de alta calidad (“OUSD”) para el año escolar 2022-23. 1) I am willing and able to follow all federal, state, local, and OUSD healthy safety protocols. I will, during my participation in OUSD, act in a reasonable and safe manner and shall take all reasonable precautions when using OUSD equipment. I will complete all training, follow safe practices/protocols and the rules of OUSD, and will wear safety equipment, as instructed I will stop my participation in OUSD and notify OPEF Oakland School Volunteers Staff (osv@oaklandedfund.org) and the OUSD staff-member or if I sense or observe any unusual hazard or unsafe condition, or if, at any time, I feel or am unable or unfit to safely continue for any reason in volunteering. I understand and acknowledge that my safety during volunteering is solely my responsibility. || Estoy dispuesto y soy capaz de seguir todos los protocolos de seguridad saludable federales, estatales, locales, y de OUSD. 2) I agree to remain home, cease volunteering, and immediately inform OPEF Oakland School Volunteers Staff (osv@oaklandedfund.org) and the OUSD staff-member I’m assigned to if: 1) I test positive for COVID-19; 2) I am exposed to COVID-19; 3) I develop symptoms of COVID-19, such as a cough or a fever.

6) Insurance. I understand that the Releasees do not carry or maintain health, medical, or disability insurance coverage for any participant, including myself, and that I am expected to arrive with medical or health insurance coverage in effect. || Seguro. 7) Authorization of Releases to Obtain Medical Treatment for Me. In the event of accident or injury, I AUTHORIZE the Releasees or their service providers to obtain medical assistance deemed necessary in their discretion. I assume responsibility to pay for all medical and emergency expenses, including transport, in the event of any accident or injury I incur because of volunteer participation regardless of whether I have authorized such expenses. || Autorización de Liberación para Obtener Tratamiento Médico para Mi. 8) Waiver of Workers Compensation Claims. I intend to participate in OUSD schools voluntarily and will receive no compensation or remuneration for participating in OUSD activities. I understand and agree that neither the Oakland Public Education Fund nor OUSD will provide worker’s compensation insurance for me in this capacity. (Do NOT initial this paragraph if you are an employee of the Oakland Public Education Fund.) || Renuncia de Reclamos de Indemnización laboral. 9) General Waiver and Release. I agree and understand that, on behalf of myself and each of my assignees, heirs, distributes, guardians, and legal representatives, I hereby knowingly and irrevocably waive any and all claims that I or my next of kin may have against the Releasees (as defined below), and release and forever discharge the Releasees from and against any and all liability for any loss, claims, suits, damages, expenses, or demands, arising or connected with personal injuries, including disability, death, and property damage, howsoever caused, that I or my next of kin or third parties may suffer, whether such liability arises by negligence, by reason of breach of a legal or statutory duty of care, or otherwise, on the part of the Releasees arising out of or in connection with my participant with OUSD. “Releasees” means Oakland Unified School District and the Oakland Public Education Fund and each of their affiliates, successors and assigns; their respective directors, officers, employees, trustees, agents, independent contractors, subcontractors, OUSD equipment suppliers, OUSD participating companies, volunteers, and representatives, including each of their heirs successors, administrators, affiliates and assigns. I shall indemnify and hold harmless the Releasees from and against all liability for any loss, damage, injury, expense or costs (including reasonable legal fees and expenses) suffered or incurred by any third party resulting from my participation in OUSD. I agree not to sue or otherwise make any claim against the Releasees for injury or damage however caused, whether by negligence or otherwise, because of my participation in OUSD. I further understand and hereby expressly waive all rights and benefits conferred upon me now or in the future under Section 1542 of the Civil Code of California, as amended (“Section 1542”), and any similar law of the United States or any state or territory thereof. I understand and acknowledge that Section 1542 reads as of the date hereof as follows:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY. |||

10) General. I acknowledge and expressly agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of California, and that this Agreement and all claims arising out of or from this Agreement shall be governed by and interpreted in accordance with the laws of the State of California. I agree that if any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement which shall continue to be enforceable. The title of this Agreement and all captions and headings of this Agreement are intended for reference only and shall not affect the legal interpretation of this Agreement.
