Release & Waiver of Liability and Scope of Consent
In consideration of your receipt of the device(s) noted above, you hereby agree to the releases and waivers contained herein. You should read this Release & Waiver of Liability and Scope of Consent section carefully as it releases the Oakland Public Education Fund, Oakland Unified School District, Tech Exchange and their respective officers, directors, board members, employees and agents from all liability relating to your or your student’s use of the device(s) including any claims related to privacy/confidentiality of such use, information used to determine your eligibility to receive such device(s), other privacy concerns and/or data protection, as well as any claims related to any harmful effects of excessive screen time, theft or damage to the device(s) or any use of the device(s) by anyone. It also gives the Oakland Public Education Fund, the Oakland Unified School District and Tech Exchange the right to use likenesses obtained of you and/or your student regarding receipt and/or use of the device(s). For good and valuable consideration, you agree as follows:
You hereby authorize the use of your and/or your child’s voice, appearance, image, photograph, video recording, and/or likeness (the “Materials”), via recordings made, by the Oakland Public Education, Oakland Unified School District, and/or Tech Exchange and their respective officers, employees and agents (collectively, the “Released Parties”) in perpetuity and in any way or in any manner of media now or hereafter known in connection with or arising out of your receipt of the device(s). You hereby authorize the Oakland Public Education Fund to obtain and hold all rights to such Materials, including any copyrights, and to copy, edit, distribute, create derivative works of and otherwise use such Materials in its sole discretion.
You hereby irrevocably release and promise not to pursue the Released Parties for any claims, demands, causes of action, losses, expenses, costs or liability of any nature whatsoever which your or your child may hereafter have against any of them arising out of in in connection with your receipt and use of the device(s) or related to the Materials, including without limitation any and all claims for invasion of right of publicity, privacy, defamation, or other claims or causes of action arising out of the production, reproduction, distribution, broadcast, exhibition or other exploitation of the Materials, as well as any claims related to any harmful effects of excessive screen time, theft or damage of/to the device(s), and/or use of the device(s) by you, your child or anyone. You also agree to ask for clarification when needed. You knowingly and freely assume all risks related to your or your child’s receipt and/or use of the device(s), even if arising from the negligence of the Released Parties or others, and assume full responsibility for your or your child’s receipt and/or use of the device(s). This waiver and release is governed by the laws of the State of California without regard to the conflict of laws provisions thereof. In the unenforceable or void, this Release shall continue in full force and effect without said provision. You represent that you are 18 years of age or older, that you are the parent or legal guardian of the child being receiving the device(s), and that you have read the above terms and conditions and agree to the following:
I have read the above terms and conditions and fully understand the assumption of risk, waiver and consent contained therein as the parent/guardian. I further understand that I and my child have given up substantial rights by agreeing to these terms and I agree to these terms freely and voluntarily and without inducement for myself. I give my consent for my child to receive and/or use the device(s).

En consideración de su recibo del(los) aparato(s) notado(s) arriba, usted está de acuerdo con las liberaciones y renuncias contenidas aquí. Usted debería leer la sección de esta Liberación y Renuncia de Responsabilidad y Alcance de Consentimiento con cuidado puesto que libera al Fondo de Educación Pública de Oakland, Distrito Escolar Unificado de Oakland, Intercambio de Tecnología y de sus respectivos oficiales, directores, miembros de la junta escolar, empleados y agentes de toda responsabilidad relacionada al uso de usted o de su estudiante del(los) aparato(s) incluyendo cualesquier reclamos relacionados a la privacidad/confidencialidad de tal uso, información usada para determinar su elegibilidad para recibir tal(les) aparato(s), otras preocupaciones de privacidad y/o protección de data, así como cualesquier reclamos relacionados a cualesquier efectos dañinos de uso excesivo de pantalla, robo o daño al(los) aparato(s) o de cualquier uso del(los) aparato(s) por cualquiera. También les da al Fondo de Educación Pública de Oakland, al Distrito Escolar Unificado de Oakland y al Intercambio de Tecnología el derecho de usar semejanzas obtenidas de usted y/o de su estudiante en cuanto al recibo y/o uso del(los) aparato(s). Para buena y valiosa consideración, usted está de acuerdo con lo siguiente:
Usted, por la presente, autoriza el uso de la voz, aspecto, imagen, fotografía, grabación de video de usted y/o de su niño y/o semejanza (los “Materiales”), vía grabaciones hechas, por la Educación Pública de Oakland, el Distrito Escolar Unificado de Oakland, y/o el Intercambio de Tecnología y sus respectivos oficiales, empleados y agentes (colectivamente, las “Partes Liberadas”) en perpetuidad y de cualquier modo o en cualquier manera de los medios ahora o de aquí en adelante conocidas en conexión con o surgiendo del recibo del(los) aparato(s). Con la presente, usted le autoriza al Fondo de Educación Pública de Oakland a obtener y a mantener todos los derechos a tales Materiales, incluyendo cualesquier derechos de autor, y copiar, editar, distribuir, crear obras derivativas de y de otra manera usar tales Materiales en su única discreción.
Con la presente, usted libera irrevocablemente y promete no perseguir a las Partes Liberadas en cualesquier reclamos, demandas, causas de acción, pérdidas, gastos, costos, responsabilidades de cualquier naturaleza en absoluto que usted o su niño puedan de aquí en adelante tener en contra de cualquiera de ellos surgiendo de o en conexión con el recibo y uso del(los) aparato(s) o relacionado a los Materiales, incluyendo sin limitación a cualesquier y a todas reclamaciones de invasión de derechos de publicidad, privacidad, difamación, u otras reclamaciones o causas de acción surgiendo de la producción, reproducción, distribución, emisión, exhibición u otra explotación de Materiales, así como cualesquier reclamaciones relacionadas a cualesquier efectos dañinos de uso excesivo de tiempo de pantalla, robo o daño de/al(los) aparato(s), y/o el uso del(los) aparato(s) por usted, su niño o cualquiera. Usted también está de acuerdo de pedir clarificación cuando se necesite. Usted, a sabiendas y libremente se responsabiliza de todos los riesgos relacionados al recibo y/o uso del(los) aparato(s) de usted o de su niño, aunque surjan de la negligencia de las Partes Liberadas o de otros, y se responsabiliza de la completa responsabilidad del recibo y/o uso de(los) aparato(s) de usted o de su niño. Esta renuncia y liberación es gobernada por las leyes del Estado de California sin consideración a los conflictos de leyes o provisiones de las mismas. En lo no ejecutable o nulo, esta Liberación continuará en vigor y efecto completos sin dicha provisión. Usted representa que usted tiene 18 años de edad o más, que usted es el padre o guardián legal del niño recibidor del(los) aparato(s), y que ha leído los términos y condiciones arriba y que está de acuerdo con lo siguiente:
Yo he leído los términos y condiciones arriba y comprendo completamente la responsabilidad de riesgo, renuncia y consentimiento contenidos aquí como padre/guardián. Además, comprendo que mi niño y yo hemos rendido derechos considerables al estar de acuerdo con estos términos y estoy de acuerdo libre y voluntariamente sin incentivo a mí mismo(a). Yo doy mi consentimiento para que mi niño reciba y/o use el(los) aparato(s).
